The alleged perpetrator of the Xerox Credit Union robbery and homicide won’t face the federal death penalty.
Richard Wilbern was brought into federal court in Rochester today in the 2003 holdup. Wilbern is accused of using a handgun and a shotgun to rob the credit union in Webster and to murder Raymond Batzel, who was in the credit union making a car payment. Wilbern allegedly fled with more than $10,000.
The judge decided today the court won’t seek the death penalty for the Batzel murder.
