After years of legal wrangling, a State Supreme Court Judge has dismissed all but one of the remaining lawsuits against the Whole Foods Plaza development in Brighton. That remaining case, dealing with access to a hiking and bike trail behind the complex, goes to trial on December 5th.
Both the Daniele Family which is building the plaza and Brighton Grassroots, one of three groups opposed to it, expressed satisfaction with the judge’s ruling.
The trial will focus on whether there should be a town-wide vote to ratify the town’s decision to give the Auburn Trail to the developers.
The plaza began construction in 2020 and the Whole Foods is scheduled to open in February. Much of the plaza has already been leased out.
