Rochester Mayor Lovely Warren and two co-defendants have been denied permission to move their trial out of Monroe County. They have been indicted on two felony campaign charges, essentially saying that they improperly used money from the mayor’s Political Action Committee to evade campaign finance limits.

The Appellate Division of State Supreme Court ruled the defendants failed to demonstrate that it would be impossible to find a jury that had not been tainted by media coverage of the indictments. It said the defense motion was “premature.”

The court said it would consider moving the trial if an impartial jury could not, in fact, be seated.
