Verizon wireless is suing the City of Rochester, saying the city’s Telecommunications Code violates FCC regulations for cellphone companies.

Verizon is complaining of right-of-way compensation fees, pole attachment fees and wireless facility attachment fees charged by the city. The company also says underground and aerial installation fees in the city code are unreasonable.

The disagreement arose when Verizon began planning to upgrade its network to 5G standards. The company wants the city’s code to be set aside.

The city says it based its code on comparable fees and policies set by other cities and is confident the lawsuit is frivolous.
