A neighborhood group has filed suit trying to block the proposed WholeFoods development in Brighton. The organization called Brighton Grassroots LLC filed court papers against the WholeFoods developers and 13 other parties, including the Town, the Town Planning Board, Rochester Gas and Electric and several other businesses along Monroe Avenue.
The suit contends the town is inappropriately applying state zoning law and violating both state and town zoning codes by granting an incentive zoning status for the project.
The Town Board voted to approve the Monroe Avenue WholeFoods on March 28th after the Daniele Family agreed to downsize the project and make sure traffic would only enter and exit on Monroe Avenue, diverting it away from the surrounding residential areas. The project is now before the Town Planning Board for site plan approval.
