A judge has thrown out one of the three lawsuits filed against the Whole Foods project in Brighton.
The lawsuit was brought by the Clover-Allen’s Creek Neighborhood Association, which is concerned with increased traffic in the area. The judge dismissed all their causes of action.
Developer Danny Daniele said the ruling sends a clear message that the suits brought against his project are baseless, and he repeated his claim that they’re backed by Wegmans. That’s something Wegmans denies.
Two suits against the Whole Foods project on Monroe Avenue are still pending. One comes from Brighton Grassroots LLC, another neighborhood group which says the project is too big for the site.
