New York State’s Department of Public Service has sent a letter to the CEO of Charter-Spectrum Cable, saying the company is running false advertising.

At issue are the company’s current ads, saying Spectrum has exceeded its targets for expanding broadband internet service to unserved areas of Upstate New York. The DPS says that’s not true, and the State Public Service Commission is currently suing Charter-Spectrum because of it. The state is demanding that Charter Spectrum shut down the ad campaign.

The PSC says under the terms of the Spectrum-Time Warner merger deal, Charter Spectrum missed the broadband expansion target it was given by more than 12,000 homes.
