Yates County District Attorney Todd Casella has been named a special prosecutor to handle the DWi case of Assembly Minority Leader Brian Kolb. A judge from outside Ontario County will also be appointed to handle the case.
Kolb was found with his state-issued SUV in a ditch off his property in Victor late on New Year’s Eve. Ontario County Deputies say he failed sobriety tests and his blood alcohol level tested at above .08. Kolb has apologized for a serious lapse in judgement.
Meanwhile, the Niagara Gazette reports a state ethics probe has begun into whether Kolb misused his state-issued GMC Acadia. The State Joint Commission on Public Ethics will not confirm that story.
