Monroe County officials confirm a sex offender charged in the rape of a 13-year-old girl should not have been working at a corner store, directly across the street from a school, where the assault took place.

Shadad Algaithy is one of two men accused of locking the girl in the store when she came in to make a purchase and raping her. He was convicted in 2021 of first degree disseminating indecent material to a minor. Monroe County’s Office of Probation and Community Correction says in a statement that Alglaithy should not have come within 1,000 feet of a school.

Rochester Mayor Malik Evans began legal action against the store, saying the city is talking with the building’s owner about what sort of business should be there. City Corporation Counsel Linda Kinglsey also said with the discovery of an illegal weapon and drugs in the store as well as the rape allegation, the city is taking immediate action to ensure it’s no longer a threat to the community.

Neighbors rallied outside the store Tuesday evening demanding action and stricter policies for sex offenders working inside stores.

Both Algaithy and suspect James Hampton will be back in court on Thursday.
