mugshot-brodzinskiA State Supreme Court Justice has sentenced a Rochester man to six months in jail and five years of supervised release on an evidence tampering charge.

Judge Scott Odorisi told Daniel Brodzinski to think long and hard while behind bars about what he failed to do when Melissa Autobee collapsed in his apartment last year after shooting heroin. Investigators said Brodzinski first flushed the heroin and got rid of the syringe, called a buddy for help, and waited 75 minutes to call 911.

By then, Autobee was brain dead.

Brodzinski pleaded guilty to the evidence tampering charge, but prosecutors weren’t able to definitively prove that Autobee’s death was the direct result of his failure to call for help right away.
