Democratic State Senate Candidate Steve Glickman says he’s been notified Republicans are going to the Court of Appeals to overturn a lower court ruling that put him back on the ballot against Republican incumbent Rich Funke.

Glickman was thrown off the ballot by the State Supreme Court earlier this month after Republicans sued, saying Glickman had violated New York’s residency requirement by registering to vote in Washington, D.C. while he was working there.

This week, the Appellate Division reversed the lower court and said Glickman had always been a legal New York State resident. Republicans have filed a notice of appeal to the state’s highest court.
