The Greece woman who was freed after her conviction in a “shaken baby” trial was overturned by a judge has reached a plea agreement with the Monroe County District Attorney’s Office.
Renee Bailey will plead guilty to an assault charge in the death of Brittney Sheets in order to avoid a second trial on the original murder charge. She will not serve any additional jail time.
Bailey was found guilty in 2001 of causing fatal injury to the toddler by shaking her. A judge set aside her conviction last year after finding that scientific opinion about “shaken baby” syndrome had changed over 10 years. He ruled Bailey might not have been convicted if the trial were held today.
A court ruled a month ago that Bailey would have to undergo a retrial even though her original conviction was thrown out.
