A Penfield man found guilty four years ago of causing a Fairport teacher’s death will avoid a second trial, and also get a slight reduction of his sentence and his fine after accepting a plea offer from the Monroe County District Attorney.

Mark Scerbo was found guilty in 2013 of manslaughter and drunken driving after his motorcycle crashed into Heather Boyum’s bicycle on Route 250. The impact catapulted Boyum into the path of a car being driven by Scerbo’s girlfriend, and she was killed. An appeals court overturned his sentence earlier this year over an issue involving a juror challenge the trial judge rejected.

Scerbo had been sentenced to seven-and-a-half to 15 years in prison and more than $25,000 in fines and restitution. Under the plea deal supported by the victim’s family, he’ll get seven-to-14 years and a reduced fine.

After a conference with the Boyum family in his chambers, the judge approved the deal in the interests of sparing the family from going through the second trial.
