Rochester City Court Judge Leticia Astacio will face one charge less when she returns to court in March to face accusations that she tried to circumvent the ignition interlock device on her car.

Assistant Ontario County District Attorney Zachary Maurer says they’re dropping one of the accusations because they believe the judge’s young son blew into the device without her knowledge, while she was in a store on January 30th.

The Ontario County D.A.’s office and an Ontario County judge are handling the case,  which accuses Judge Astacio of violating her conditional discharge of a DWI conviction.  Maurer says he will attempt to prove that a violation did take place on January 12th.  

Photos taken by the device show Astacio’s adult daughter blowing into it to start and drive the car.  Maurer says Astacio then took over behind the wheel without first shutting off the car as required.
