New York Attorney General Eric Schneiderman says late-term abortions may be performed in the state when the fetus is non-viable or the mother’s health is in jeopardy.
Schneiderman’s legal opinion was requested by the State Comptroller’s Office to clarify whether it has authority to make Medicaid payments to health care providers for that type of abortion.
New York law on the subject was written before “Roe vs. Wade.” It says late term abortions are legal if necessary to preserve the woman’s life. Schneiderman’s ruling clarifies it’s “life or health” in accordance with the Supreme Court’s ruling in “Roe.”
The state Catholic Conference says that’s nothing more than “abortion on demand” anytime. The New York Civil Liberties Union says it clears up that “Roe vs. Wade” is the law of the land everywhere.
