A Naples man has been arrested for driving with a blood alcohol content of five times the legal limit.

The Livingston County Sheriff’s Office says 54-year-old James Rathbun was pulled over on Plank Road in Livonia for a traffic law violation. The deputy decided he was drunk and called in the STOP DWI unit to investigate.

After failing field sobriety tests, Rathbun was brought to the Livingston County Jail where he blew .40 on a breathalyzer. That’s four times the legal limit of .08. They charged him with aggravated DWI, and found he’d been arrested for the same thing just last week in Cohocton. He’s being held on $500 bail.
