The Monroe County District Attorney is appealing a judge’s decision to throw out the murder charge against Charlie Tan of Pittsford.
Tan was accused of shooting his father to death at their Pittsford home in February of 2015. Judge James Piampiano threw out the case after Tan’s trial ended with a hung jury.
Assistant DA Kelly Wolford says she completely disagrees with the judge’s decision. She says it’s in the best interests of the community that Tan be tried again for his father’s murder. The DA’s office is asking the Appellate Division of State Supreme Court to reverse Judge Piampiano’s decision.
Wolford says it would be up to the courts to decide if a new trial would have a new judge…but Judge Piampiano no longer sits on criminal cases.
