The case of a Kendall landlord whose generator caused the Carbon Monoxide deaths of a woman and her son will go to an Orleans County Grand Jury.

David Wiley was in court briefly on Monday, where his case was referred to the grand jury after he rejected a plea agreement. He would have served nine months in jail.

Wiley was the caretaker of a duplex apartment house where Joan Gilman and her son, Richard, also lived. Prosecutors say he ran a generator in a closed garage under their bedroom for 17 hours after National Grid shut off their power. Both died of CO poisoning.
