A judge has dismissed a lawsuit filed by meterologist Jeremy Kappell against the City of Rochester, Mayor Lovely Warren and WHEC TV.
Kappell was fired from WHEC (News 10 NBC) after he referred to Dr. Martin Luther King Jr. Park in Rochester as “Martin Luther C–n King Park” during a broadcast on January 4th, 2019.
Mayor Warren accused Kappell of using a racial slur and called for him to be fired. He claimed he misspoke and made a slip of the tongue.
Kappell’s suit charged WHEC and Hubbard Broadcasting with breach of contract, defamation and intentional infliction of emotional distress.
A State Supreme Court justice ruled the station was within its rights to fire Kappell, who has since started his own online weather forecasting business.
