A man with a violent felony record that includes the shooting of a Rochester police officer has been released on bail under the new state laws that took effect New Year’s Day.
Prosecutors say the judge had no choice but to set Tyquan Rivera free on an electronic monitoring bracelet under the new law.
When Rivera was 14, he shot Rochester Police Officer Anthony Diponzio and served a 10-year sentence, the maximum he could be sentenced to as a juvenile. Now 25, he was released from prison late last year and then was arrested on two counts of selling fentanyl to an undercover officer.
Assistant District Attorney Matt Schwartz said “our hands are tied.”
