A Rochester man who was acquitted last year of charges that he tried to kill a Rochester Police officer has had the last charge against him thrown out.
Silvon Simmons had been convicted on a count of criminal possession of a weapon. The Monroe County District Attorney’s Office says a judge has now dismissed that charge and thrown out the evidence the DA’s office used to prosecute Simmons.
The District Attorney intends to appeal in an effort to reinstate the underlying indictment, which accused Simmons of attempted aggravated murder and attempted aggravated assault of a police officer.
