A Livingston County judge has resigned, according to the New York State Commission on Judicial Conduct.
Judge James Mann resigned as a Nunda Town and Village justice effective December 1st. His resignation is the result of disciplinary charges in connection with a 2016 incident in which he tried to get his brother-in-law off of a DWI charge.
Mann’s former brother-in-law had been stopped by Mt. Morris Police and failed field sobriety tests. During the stop, Mann’s ex-wife called to let him know what was happening. Mann then called the Mt. Morris police chief and asked if he couldn’t give his brother a break. The chief then told one of his officers, who let the man go.
The commission says exerting such influence is obviously dangerous and wrong.
