A Leroy man who shot his neighbor to death, then burned down his own house while firing shots at first responders is headed for a mental institution instead of prison.
Kyle Johnson was brought into a Batavia courtroom Monday, where he was “not guilty by reason of mental defect or disease.” Two psychiatrists independently examined the 53-year-old man and both concluded he was unfit to stand trial.
Johnson was accused of entering the home of neighbor Norman “Don” Ball and shooting him to death in his bed before burning his own house down. The victim’s daughter, Shawna Geil hopes Johnson never walks free.
Johnson will be taken to the Rochester Psychiatric Center where he will get further mental health evaluations. He could be in mental health care for the rest of his life.
