Charging documents released by the Ontario County Sheriff’s Office say former Assembly Minority Leader Brian Kolb was at twice the legal limit when he drove his state-issued SUV into a ditch on New Year’s Eve.
Kolb was charged with DWI after a tow truck operator called 911 and he subsequently failed field sobriety tests. A blood alcohol test came up .16, double the .08 limit.
The documents say the Assemblyman told the tow truck operator his wife had been driving when the SUV went into the ditch. He later told deputies he had “four or five cocktails” at the Erie Grill in Pittsford before driving the 15 miles to his home in Victor.
Kolb resigned his leadership position but remains in the assembly.
