Former State Assembly Minority Leader Brian Kolb pleaded not guilty at his first court appearance following his DWI arrest on New Year’s Eve.

Kolb surrendered his driver’s license and was given a 30-day permit to drive to work and back. He was also ordered to undergo a drug and alcohol evaluation, which his attorney says Kolb has already done.

Kolb told waiting reporters that a tow truck drive got it wrong when he swore in an affidavit that the assemblyman tried to say his wife had been driving at the time his SUV went into the ditch outside his home. Kolb says he was joking but doesn’t remember everything that was said. He says he would never throw his wife under the bus.
