A judge who changed her mind after handing down a “not guilty” verdict in a drunk driving case has unchanged her mind today.

As first reported by 13 WHAM, City Court Judge Maija Dixon ruled that evidence in a DWI charge against a Niagara Falls man stopped for speeding on 490 in Rochester two years ago didn’t add up. She declared Jonathan Crane “not guilty” last month after the arresting officer was unable to identify him during his trial.

 

Judge Dixon then called Crane’s attorney back into court a week later and announced she was reversing the trial decision after another review of the evidence. But lawyers not connected to the case say a judge can’t do that, as past cases in state appeals courts have established.
Today the judge reversed herself again and will let the original “not guilty” verdict stand.
