The developer of the Whole Foods Plaza in Brighton says they are now free to open in early spring, after a judge on Wednesday ruled against a community group that contends the plaza was partially built on a public access trail.
State Supreme Court Judge Scott Odorisi ruled the Whole Foods on Monroe Avenue was not infringing on public land and dismissed all claims related to the trail.
Brighton Grassroots and Save Monroe Avenue say they will appeal the ruling. The groups have been supported by Wegmans which has its flagship store just up Monroe Avenue in Pittsford. They’ve tried through lawsuits to stop the project over the past four years.
