Rochester City Court Judge Leticia Astacio was back in her own court today after being accused of violating parole. The Monroe County District Attorney’s Office wants the judge to seek drug and alcohol treatment.
Judge Astacio asked that her privacy be respected and made no comment leaving the courtroom.
Judge Astacio was sentenced to pay a $500 fine and have an breath detector interlock device installed in her car for a year after being tried on a misdemeanor DWI charge earlier this year. But prosecutors say on September 7th, she blew a .019 blood alcohol level, which is just at the threshold allowed by the device. On September 12th it registered .067, which is a violation.
Prosecutors say if the judge seeks treatment by November 16th, they won’t seek additional penalties.
