According to papers filed in City Court last week, suspended City Court Judge Leticia Astacio was accused last year by a security guard of being drunk at a restaurant in the Marketplace Mall.

The Declaration of Delinquency filed against the judge on Friday (and posted on SCRIBED courtesy of the D&C Digital) states that Astacio has twice violated the terms of her conditional discharge on a drunken driving conviction last year, and it requires the judge in her case to decide what to do about it.

The declaration says Judge Astacio was observed, apparently intoxicated, at the Papaya Asian Kitchen and Bar at the mall in Henrietta. This was at about midnight on November 20th. Four days earlier, she had admitted in court to violating the terms of her conditional discharge on a drunken driving conviction. They require her to abstain from alcohol for a year and not to violate any state laws. The declaration says Astacio also apparently drank alcohol with several other women at a bar on State Street on November 24th. She turned up in photos posted on social media.

Security Guard Alan Pimm told police he checked a bathroom at the restaurant after a female server complained a group of women were inside and refused to leave. He stated that he recognized the judge, and determined she was impaired due to slurred speech and lack of balance.

The judge has been relieved of her duties, but still keeps the title and her $173,000 a year salary as an elected official.
