Ontario County Court Judge Stephen Aronson has ruled that Rochester City Court Judge Leticia Astacio did not violate the terms of her DWI sentence.
Judge Aronson found there was a lack of evidence to prove Astacio was drinking at a Thanksgiving party. Photos posted on Facebook showed her with a group of friends, holding a plastic cup. A tequila bottle was on the table, but the judge said there was only circumstantial evidence to show she was drinking alcohol there, or at a restaurant in Henrietta where a security guard said he believed she was intoxicated.
Judge Aronson dismissed a charge that Judge Astacio tried to circumvent her car’s ignition interlock by having someone else blow into it. He also transferred her supervision from Ontario County to Monroe County’s probation department.
Judge Astacio remains on suspension because of her conviction, but continues to draw her salary.
