Suspended Rochester City Court Judge Leticia Astacio again denied on Monday that she violated her conditional discharge on a drunken driving sentence by drinking.

The judge was back in court for the second day of a hearing on allegations that she violated her sentence. She denied being intoxicated or drinking, including on an occasion at the Papaya Restaurant in Henrietta when a security guard said she appeared to be drunk.

The prosecution says the guard’s evidence shows that she was stumbling and leaning on other people that night. She’s also accused of drinking with friends on Thanksgiving, at a party where photos were posted to social media, and of misusing her ignition interlock device.

Judge Stephen Aronson must decide if there’s enough evidence to uphold the allegations, and if so should her sentence be altered. He could put her on probation or force her to enter rehab. He’ll release his decision on March 27th.
