The Rochester man who was twice tried and convicted of murder has been sentenced to 25-year-to-life in prison.
State Supreme Court Justice Francis Affronti sentenced 48-year-old Jose Torres for the second time in the murder of Miguel Danny Cruz, 15 and a half years ago. Torres won a second trial after his attorney found that another man, Angel Carrasquillo, had also confessed to being involved in the Cruz murder.
But the prosecution brought evidence to show that Torres had confessed both to friends and police that he had pulled the trigger, and showed police where he threw the gun into the Genesee river.
Carasquillo has been indicted as an accomplice in the Cruz murder and will be tried later this year.
