An attorney representing former East High School student Abigail Hernandez will seek asylum for her from the federal immigration court in Batavia.
Hannah Vinckner-Hough says her client, Abigail Hernandez, will have to demonstrate she faces persecution if she returns to her birthplace in Mexico. It has to be persecution under one of five categories including race and religion. She says Hernandez’ learning disability won’t count.
Hernandez has been in America since she was three and has no family in Mexico. She got in trouble for texting threats to East High, which cost her her DACA protection.
