A Monroe County Grand Jury charged an alleged heroin dealer on two counts of criminal sale of a controlled substance and two possession charges. Dominic Hobbs was not indicted on the main charge Gates Police brought against him, that of criminally negligent homicide in the overdose death of a Gates woman.  But the District Attorney’s office says that’s because they haven’t presented that evidence yet.

DA Sandra Doorley’s staff says they’re waiting for the Medical Examiner’s report before trying to indict Hobbs on the more serious charge, and the toxicology testing will take weeks or months to complete.

Gates Police brought the homicide charge against Hobbs after he was arrested last month in connection with the death of Tara Miles. The 41-year-old woman was found dead in her home of a heroin overdose.

Police are hoping the criminally negligent homicide charge will become a tool they can use against drug dealers to curb the plague of heroin overdose deaths.
