An apparent clerical error has caused another delay in re-sentencing convicted murderer Frank Garcia.
Prosecutor Perry Duckles confirms that this time it wasn’t Garcia refusing to come to court or cooperate with his attorney. Somehow, the Monroe County District Attorney’s request for Garcia to be brought to court wasn’t received or was overlooked by officials at Attica State Prison.
Garcia was found guilty of murdering four people during a spree targeting people he believed had conspired to get him fired from his job in 2009. Two of the victims were women who complained he had sexually harassed them. One of the three life sentences he received was later overturned on appeal, and Garcia is to be resentenced on that count to a lesser penalty.
But last month, Garcia refused to cooperate with his attorney and the case was adjourned. Garcia was to have been back in court today but was not transported from Attica to Rochester.
They’ll try again on Friday.
