The family of state parole officer Sandy Guardiola has filed a federal wrongful death lawsuit, one year after she was shot and killed by a Canandaigua police officer.

Guardiola’s family and estate are suing the city of Canandaigua, the department and Sargent Scott Kadien, as well as state parole officials and the management company of Guardiola’s apartment building. They’re seeking $50 million in damages.

According to a state police investigation, the officer entered Guardiola’s apartment to check on her welfare after he employer became concerned. Management let Sargent Kadien into her apartment. She fired her gun at him and he fired back, killing her.

The family’s attorney says forensic evidence will show that’s not what happened that day.
