The family of a pedestrian struck and killed by a car, plus Monroe County Legislator Rachel Barnhart, are calling for more openness from Rochester police when a fatal accident occurs

In the case of Roderick Cunningham, struck and killed by a car on Parsells Avenue earlier this month, police did not release the driver’s name after their investigation showed he was not at fault. Barnhart says this caused rumors to fly about the driver being somehow shielded by police. Barnhart and the Cunningham family say they have been given few details about the accident. They want names of drivers to be released in all accidents involving a fatality.

13WHAM TV obtained the accident report through a Freedom of Information request. It showed 41-year-old driver Richard Augsbury was neither drunk nor speeding when he hit Cunningham. Augsbury told police the headlights of a second car put a glare on his windshield so that he couldn’t see the victim. Police did not charge him.
