A report from the New York State Attorney General’s Office says a Monroe County deputy should not face charges for a fatal accident back in December that killed a Perinton man.

Deputy Michael Houlihan was driving on the Pittsford-Palmyra Road at Mosely Road when he slowed down about 2:30 a.m. to look at what he thought might be a stolen car in a bank parking lot. He felt a thump and found he’d hit 32-year-old Wesley Soper who was walking across the intersection.

Attorney General Letitia James says a review of all evidence including body-work camera footage and accident reconstruction shows Houlihan was going slightly above the speed limit, but not enough to be negligent. The review found Soper was wearing dark clothing and headphones, crossed against the light and didn’t use the crosswalk signal.

Deputies and an ambulance crew tried to save Soper, but he died a short time later at Strong Memorial Hospital.
