Gavel 1The Appellate Division of State Supreme Court is heard arguments today as the state seeks to dismiss a lawsuit filed by parents of students in charter schools.

 

The suit was filed two years ago. It says New York’s charter school funding system is unconstitutional, because it gives those schools less money per student than traditional public schools: statewide, 75-cents on the dollar, and in Rochester 68-cents on the dollar.

The state says charter schools get less because they can pick the best students, and they’re not mandated to provide special education and other costly services.

A Supreme Court judge rejected the state’s motion to dismiss the case last year. The state appealed.
