The Rochester City Council says it will continue to appeal a court ruling that stripped the city’s Police Accountability Board of its intended power to discipline officers for misconduct.
That provision of the PAB law was overturned by the State Supreme Court, and that decision was just upheld by the Appellate Division. Council will now take the case to the highest state court, the Court of Appeals.
Council President Loretta Scott says the city previously set aside funding in case it had to continue the appeal.
The courts have so far held that the PAB exercising disciplinary power over police officers would violate their collective bargaining agreement.
