By a vote of 6-3, the Rochester City Council Tuesday night voted down a bill that was meant to provide tenants with protection against unfair evictions.
The intent of the Good Cause Eviction law was to prevent landlords from evicting tenants on month-to-month leases in order to rent the same properties out for more money as rents rise following the pandemic. It would have required one of a list of so called “Good Causes” to be able to evict a tenant. The vote came after a public hearing last week, and another one Tuesday night involving landlords, renters and renter advocates.
Voting “yes” on the measure were Councilmembers Mary Lupien, Stanley Martin and Kim Smith. All other councilmembers voted “no.”
Earlier this month, the city’s lawyers advised the legislation would be invalid under New York’s Constitution and the United States Constitution because it would violate the federal rights of landlords. Several council members including Mitch Gruber and Willie Lightfoot said that was their reason for voting no.
