The Rochester City Council has voted to use its subpoena power for the first time, asking the city’s police department to turn over its records on the Ricky Bryant case for review.

The 18-year-old suffered a fractured eye socket after being stopped by police while leaving last summer’s Puerto Rican festival. Officers suspected he might be a young man on a bicycle reported to be carrying a gun. Bryant, who was not the man police were looking for, claimed he was assaulted and beaten by the officers.

An internal report found the officers acted according to protocol, and the Civilian Review Board agreed. Bryant’s lawyer says the report is a cover up.

Council Public Safety Committee Chair Adam McFadden pushed the subpoena legislation. He says council not only wants to review the case, but also see if it can provide any guidance in revamping the Civilian Review Board.
