Charges have been dropped against a Churchville mother who was charged with second degree manslaughter in the death of her ten-year-old boy last June.
Dolfona Grayson and Walter Morse were both charged in December after J’Vieon Grayson-Sutton was found unconscious by his younger brother in the family’s apartment. J’Vieon had a compulsive eating disorder, and he found and ingested a fatal dose of the drug fentanyl.
The judge ruled that Grayson-Sutton was at work and had left the children in Morse’s care with an expectation he would watch them. Instead, he left them home alone.
Defense Attorney Michael Schiano says it was the right call by the judge.
But Assistant District Attorney Sara VanStrydonck disagrees. She says to be a mother and leave a child in a small apartment with a deadly drug is reckless conduct.
