The man who was driving drunk when he ran down a three-year-old boy on Lyell Avenue has been indicted by a Monroe County Grand Jury.
Frank Cassata was indicted on seven charges, starting with second degree murder. He’s also charged with vehicular homicide, vehicular manslaughter, leaving the scene of an accident and several DWI charges.
Police say Cassata was drunk when he deliberately tried to run over a man he’d been arguing with on Lyell Avenue. Instead, he hit the porch of a house and killed three-year-old Amir Pallet. His 23-year-old aunt was injured trying unsuccessfully to drag him out of the way.
