Opening statements got underway Tuesday at the trial of Leticia Astacio.
They were delayed for a time after some snags. A juror admitted seeing a TV news story last night about the case and was replaced.
The prosecution then showed security video from Dick’s Sporting Goods in Henrietta of Astacio attempting to buy a shotgun, and her probation officer testified that she was not allowed to own a weapon under her probation. Special Prosecutor Mark Sinkiewicz told reporters Astacio did briefly hold a shotgun, although the clerk refused to sell it to her. He says that Astascio broke the law, or he wouldn’t be in court
During opening statements, the defense argued again that an unloaded shotgun does not fall under the legal definition of a dangerous weapon.
