Embattled Rochester City Court Judge Leticia Astacio will spend the coming four weeks in jail…after a judge found that she violated the terms of her DWI sentence. He ordered her to be held without bail until July 6th for a probation report.
Canandaigua City Court Judge Stephen Aronson ruled at a hearing this afternoon that Judge Astacio violated her conditional discharge by not being available for a court-ordered urine test. Her attorney, Ed Fiandach, argued that Astacio never got the letter ordering her to undergo the test because she was out of the country. Astacio had left the country and spent the month of May in Thailand without notifying the court first.
Fiandach says he’ll be filing an appeal.
The prosecution had subpoenaed Fiandach as a witness, but he argued attorney-client privilege and was not required to testify this afternoon.
