Former Rochester City Court Judge Leticia Astacio will spend 180 days in jail after a judge revoked her probation.

Astacio was in court Tuesday on a motion by Astacio to vacate her three-year probation sentence for a 2016 drunken driving conviction. Astacio argued the sentence was unlawful in that proper legal procedures weren’t followed when she was put on probation, and her probation was extended from one year to three.

Instead, Judge Elisabeth Toole revoked her probation and ordered her to jail, saying Astacio had never taken responsibility for her DWI conviction and had simply decided to take herself off probation by refusing to follow the rules.
