Rochester Police have arrested a man who shot two men as they broke into his apartment in late September.  Marcus Boone wounded one of the would-be robbers and killed the other.

Boone then fled, and was located and arrested on January 8th with the help of State Police and U.S. Marshals. Police had obtained a search warrant for his apartment in the area of Dewey Avenue and Bloss Street, and found 29 bags of crack cocaine packaged for sale. That was evidently the target of the men who kicked in Boone’s door.

Injured were a 28-year-old man who was shot in the upper body, and 27-year-old Marcus Patterson, who was killed on the spot. Both had kicked in Boone’s door on September 25th before Boone shot them both.

Boone was prohibited from owning a gun because of a prior felony conviction. He’s being charged with criminal possession of a weapon and possession of stolen property (a stolen 9 mm handgun). He’s being held without bail, and a grand jury will rule on his actions in firing at the men who forced their way into his home.
