A mid-level state appeals court has thrown out a motion from Charter-Spectrum Cable to dismiss a lawsuit over the company’s internet speeds.
The State Attorney General sued Charter-Spectrum last year after it failed to meet time limits for extending its high-speed internet service to unserved communities across Upstate New York. Attorney General Barbara Underwood says Charter and predecessor Time Warner Cable promised speeds they couldn’t deliver.
The State Supreme Court refused to throw out the suit earlier this year, and the Appellate Division has now affirmed their decision.
