A state appellate court in Rochester has ruled that evidence once used to prove shaken-baby cases may no longer be scientifically valid.
The ruling upholds a Monroe County Court judge’s two year old decision reversing the conviction of Rene Bailey, a day care operator accused of causing the death of a toddler in her care in 2001.
The judges agreed newer scientific findings could have supported Bailey’s contention that the injuries were caused by an accidental fall.
